The Col·legi Oficial de Treball Social de Catalunya (TSCAT)  owns the domain names and web pages which are accessed from the following sites: www.tscat.cat and www.revistarts.com.

The TSCAT wishes to inform that it is a public law professional corporation with registered office at  Llança, 39, 08015 Barcelona, and that its Articles of Association are recorded in the Registry of Professional Associations of the Government of Catalonia, which were approved by means of the Resolution of the Ministry of Justice of said Government on 22 August 2011 (Official Journal of the Government of Catalonia dated 5.9.2011) and by means of the Resolution of the Ministry of Justice of said Government on 7 February 2019 (Official Journal of the Government of Catalonia dated 18.2.2019).

1. ACCEPTANCE AND USER TERMS AND CONDITIONS

Browsing and use of the website www.revistarts.com and the services therein assigns visitors the capacity of user thereof and, as such, implies unreserved acceptance of all of the provisions included in this notice; as a result, the user will need to read it whenever browsing or using the website.

The website www.revistarts.com enables electronic access to the issues of the Social Work Journal published by the TSCAT and, under the terms and conditions specifically set out in the relevant sections, enables access to the platform in order to submit articles and other communications to the Social Work Journal for review, approval and, if applicable, publication.

The TSCAT may amend these general and the specific terms and conditions, if applicable, at any time without prior warning by publishing the new terms on the website to ensure that users are made aware upon accessing the site.

2. GENERAL TERMS AND CONDITIONS OF USE OF THE WEBSITE

Access to the website and the services therein is free-of-charge and unrestricted, notwithstanding the services provided by the TSCAT or third parties via the website that are subject to completion of a prior form and payment in the manner specified in the specific terms and conditions applicable thereto.

The TSCAT reserves the right to set a price for services it currently offers free-of-charge after warning users by publishing the new terms and conditions on the website at least 7 calendar days in advance.

The TSCAT is not associated with the offers or services of third parties that may be accessed via the website www.revistarts.com, and merely limits itself to providing users with links enabling access to the third party websites. As such, it shall not be held liable for any information contained in said websites or for any services ordered or purchases made by users in said websites.

3. USER REGISTRATION AND USE OF COOKIES

Certain services –whether free-of-charge or otherwise– require user identification beforehand to assure that all the data they notify to TSCAT in order to complete the forms needed for use of the website are true and up-to-date. In any event, the user shall be the sole party liable for permanently keeping the data up-to-date and for all false or inaccurate statements made, as well as for any damages caused to the TSCAT or third parties owing to the information provided. The specific terms and conditions for registration are detailed in the website registration section and they are all deemed to form part of this notice.

Underage children intending to use the services offered on this website must seek permission from their parents or guardians who shall be deemed as liable for any actions they carry out while under their responsibility.

4. DATA PROTECTION

  • When you submit your personal data on the contact forms, emails and on the registration form in particular, the user is expressly consenting the TSCAT to process his personal data to respond to requests made at any time, complying with legal obligations and the Articles of Association of the Association and of the Social Work Journal, as well as to use electronic or other means to inform you about issues and services that may be of interest to you professionally.

  • The data controller shall be the TSCAT, with tax ID code Q-0869009-A and registered office at Carrer de Llança 39, 08015 Barcelona.

  • The data shall be held for as long as necessary in order to deal with your request and, in any event, for any period stipulated by the legislation currently in force.

  • You may exercise your right to access, rectify, delete, limit or object to the processing of your data by writing to the data controller by mail to the above address. The TSCAT has a data protection officer who can be contacted via catalunya@tscat.cat. You may also lodge a claim to the Catalan Data Protection Authority.

  • The personal information gathered from registered users is stored in a database owned by the TSCAT that adopts all technical, organisational and security measures needed to assure the confidentiality and integrity of the information and to protect the rights and freedoms of natural persons pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter GDPR) and Act 3/2018, of 5 December, on Personal Data Protection and the Guarantee of Digital Rights.

  • In all cases, the user shall be liable for the veracity of the data supplied, whereby the TSCAT reserves the right to exclude any user submitting false data from using the registered services, notwithstanding any other legal actions that may be brought.

  • The content of this website cannot be reproduced, modified, distributed, publicly disclosed or stored without prior permission from the TSCAT.

  • Improper use of the content of this website may be deemed a breach of copyright regulations.

  • Users must refrain from obtaining or trying to obtain the content of the TSCAT website using methods or procedures other than those made available or indicated to this end on the web pages where said content is found.

6. PROHIBITION ON HYPERLINKS

No link to the website may be set from any other website without prior, express permission from the TSCAT, with the exception of search engine access-based websites, social networks, blogs or non-profit personal pages.

7. USER OBLIGATIONS

The user undertakes to comply with these rules and, if applicable, the specific terms and conditions applicable and the special instructions regarding use contained therein or on the website, and to act in accordance with the law, custom and in good faith at all times, adopting the diligence pertinent to the nature of the service provided. The user also undertakes to refrain from using the website in any way that may prevent, alter or impair normal operation of it, the assets or rights of the TSCAT or, in general, any third party. By way of indication without limitation, when using the website and the services offered, the user undertakes to:

a) provide the data required truthfully, as necessary, in order for the service to be provided and ensure they are up-to-date; refrain from using false identities or impersonating the identity of others when using the website or any of the services offered therein, including use of passwords or access codes of third parties, if applicable, or any other unlawful means.

b) refrain from using the website to introduce, transmit or disseminate any computer programme, data, virus, code, hardware or telecommunications equipment or any other physical or electronic device or instrument that may damage the website in any service, or in any of the equipment, systems or networks of the TSCAT or, in general, of any third parties, or which would otherwise be able to cause any change to or hinder the normal operation of the aforementioned.

c) refrain from introducing, transmitting or disseminating to or from the website any information or material that is defamatory, offensive, obscene, xenophobic, an incitement to violence or discrimination owing to race, gender, ideology, religion or which is in any way a violation of morality, public order, fundamental rights, public freedoms, honour, privacy or the image of third parties and, in general, current regulations.

d) duly safeguard the “User Name” and “Password” supplied by the TSCAT to users since these are identifying elements to access the various services offered on the website, undertaking to not assign use of them or allow third parties to access them, whereby the user shall assume all liability for damages arising from improper use of said details. Moreover, the user undertakes to notify the TSCAT as swiftly as possible as to the loss or theft of the codes, as well as any risk of access to the “User Name” and/or “Password” by a third party.

e) not carry out advertising, promotional or commercial exploitation activities via the website, refraining from using the content and, specifically, the information gained via the website to convey advertising, send messages for any commercial purpose or compile or store personal data belonging to third parties.

f) refrain from transmitting, disseminating or making available to third parties information, content, messages, recordings, software and any other type of material that breaches the trade secrets of the TSCAT or third parties, which violates the secrecy of communications or the regulation governing the securities market, or which in any way undermines the credit and reputation of the TSCAT, its directors and/or employees or third parties.

g) refrain from destroying, altering, employing for use, disabling or impairing the data, information, programmes or e-content of the TSCAT or third parties.

h) refrain from introducing, transmitting or disseminating via the website any content that breaches intellectual or industrial property rights or trade secrets of third parties or, in general, any content which the user does not have any entitlement to make it available to third parties pursuant to the law.

The TSCAT reserves the right to delete comments or content posted by the user if it deems that they are detrimental to the TSCAT and/or the remaining users of the website, and/or if they breach any of the aforementioned obligations. Furthermore, the TSCAT reserves the right to refuse admission to users it deems breach these rules by blocking their access for an undefined period without the need to inform them in advance.

8. EXCLUSION FROM GUARANTEES AND LIABILITY

The TSCAT ensures that the data and content of its website www.revistarts.com are correct, although it cannot fully guarantee the accuracy, validity or the extent to which they are up-to-date, nor can it provide any assurance of its suitability for a specific purpose.

The TSCAT shall not under any circumstances be held liable for any kind of damage caused stemming from errors or omissions in content, unavailability of the website or the transmission of viruses or malware or harmful programmes in the content, among others, despite having implemented all technological measures required to prevent this.

Moreover, it shall not be responsible for, nor shall it be required to share, the opinions expressed by its (freelance) partners in articles published on this website.

The TSCAT does not generally control how users make use of the website and, specifically, under no circumstances can it assure that users will make use of the website in accordance with the law, these rules, morality, good customs generally accepted and public order, nor can it guarantee that their use will be diligent and careful.

The TSCAT shall solely be liable for damages suffered by users in using the website whenever such damage is attributable to negligence on its part, whereby the user acknowledges and agrees that use of the website and the services offered shall be under his own risk and his full responsibility.

By way of indication without limitation, the TSCAT shall not accept liability for damages arising from:

a) interruptions, breakdowns and/or disconnections in the operation of the website and the services, hindering access to it or delaying the provision of the service.

b) a lack of veracity, lawfulness, preciseness, comprehensiveness, reliability and/or currentness of the website content, as well as the existence of defects and errors of all kinds in the content transmitted, disseminated, stored and/or made available to those who gained access via the website or the services offered.

c) actions by third parties that breach intellectual and industrial property rights, trade secrets, rights to honour, personal privacy and self-image, as well as legislation in terms of unlawful advertising and unfair competition.

d) unlawful interference from third parties which may affect privacy and security in use of the website, whereby no guarantee can be given that unauthorised third parties may be aware of the circumstances surrounding the way in which users make use of the website and the services.

e) accessibility, operation or availability, content, information and services offered by third parties on websites linked from www.revistarts.com, as well as the quality, lawfulness, reliability and usefulness thereof.

9. COMMUNICATIONS

Any communication required between the TSCAT and the user must be addressed to the User Support Team by email at the address catalunya@tscat.cat or in writing to:

Communications by the TSCAT to the user shall be made by email to the address provided by the uer when contacting the TSCAT or to the address provided upon registering as a user, if applicable; by post to the address supplied by the user; by telephone call to the number supplied by the user; or by pop-up messages sent during the provision of services by the TSCAT to the user.

The user expressly accepts, for all communications relating to use of the website and/or the ordering of the services offered herein, that use of any of the aforementioned means shall be valid in order to send such communications, whereby the user states that all details supplied through this medium or to be supplied to the TSCAT are true and exact, undertaking to notify the TSCAT about any change to said details.

10. APPLICABLE LEGISLATION AND JURISDICTION

These general terms and conditions shall be governed by Spanish law. In order to solve any conflict, the parties submit to the law courts having jurisdiction pursuant to applicable regulations in each specific case.
